What a landlord needs before letting a property in Thailand
Title deed or condominium ownership certificate
Tenants and the juristic person ask to see it to confirm you are the owner and not a sub-letter. If you are letting on an owner's behalf, keep the power of attorney with it.
Written consent from the juristic person
Many condominium buildings require you to notify them before letting, and some set a minimum lease of six months or a year. Check the building rules before you list, not on the day the tenant moves in.
A written lease agreement
State the rent, the deposit, the term and who pays for repairs from the start. A lease longer than three years must be registered at the Land Office; unregistered, it is enforceable for only three.
TM.30 filing for a foreign tenant
The house master must report a foreign national's accommodation to Immigration within 24 hours. It can be filed online, there is a fine for not filing, and it is the owner's duty, not the tenant's.
Daily lets need a hotel licence
Letting for under 30 days counts as operating a hotel and requires a licence. Most juristic persons prohibit it anyway. If you let monthly, state the minimum term in the listing.
Land and building tax
A let property is assessed differently from an owner-occupied home, and rental income is declarable. Check with your district office, because the rates are re-announced each year.
What every tenant asks — answer it in the listing
- What is the monthly rent, and does it include common fees and internet
- How many months' deposit, when is it returned, and what can be deducted
- What is the minimum term, and what is owed for leaving early
- What furniture and appliances are included, is there a washing machine
- Are utilities metered by the authority or charged per unit by the building
- Are pets allowed, and how many parking spaces are included
- Who repairs what breaks, the owner or the tenant
Price against what is actually being let, not what you paid
The rent the market will bear has nothing to do with what you paid for the property and everything to do with the units currently being let in the same building or area. Look before you price, and do the vacancy arithmetic: pricing 10% above the market to gain a few thousand baht a month costs you roughly 8% of the year's income if it leaves the unit empty one month longer, which is more than the gain.
